Terms of Use

These terms are the agreement between you and Blocks Foundry LLC ("we", "us") covering your use of the CIPHER mobile application. By using CIPHER you accept them. If you do not accept them, please do not use the app.

The Service

CIPHER is a daily word puzzle game. New puzzles are published on a weekly schedule, and past weeks remain available in the Archive.

We provide CIPHER free of charge. There are no purchases, no subscriptions, and no advertising.

Your Account

You can play CIPHER without creating an account. Your progress is then saved only on the device you are playing on, and is lost if you delete the app or replace the device.

Creating an account with Sign in with Apple or Google Sign-In saves your progress to that account so it follows you between devices. You are responsible for keeping access to the provider account you sign in with — we do not hold a password for you and cannot restore access to a provider account you have lost.

One person, one account. Do not create an account on someone else's behalf or share yours.

Acceptable Use

Play the game. Beyond that, please do not:

Access CIPHER by any means other than the published app — no scraping, automated clients, or reverse engineering of the app or its servers
Attempt to read, alter, or delete another player's data, or interfere with anyone else's use of the service
Probe, disrupt, or overload our infrastructure, or circumvent any security or rate-limiting measure
Publish puzzle content in bulk, or redistribute it as your own

If you find a security problem, please tell us at support@playcipher.app rather than demonstrating it on other players. We will not pursue anyone who reports a genuine issue in good faith and gives us a reasonable chance to fix it.

Puzzle Content

The puzzles, the CIPHER name and logo, and the design of the app are ours and are protected by copyright and trademark. You may play the puzzles and share your results. You may not republish the puzzle content itself, in whole or in substantial part, without our written permission.

Nothing here stops you from talking about, reviewing, or writing about CIPHER.

Availability

We aim to publish a new week of puzzles on schedule and to keep the app working, but CIPHER is offered as it is. We do not promise that the service will be uninterrupted, that puzzles will always publish on time, or that your progress will never be affected by a fault. We may change, suspend, or discontinue any part of the app, including the service as a whole, and we will give reasonable notice in the app before doing so where we can.

Ending Your Use

You may stop using CIPHER at any time, and may delete your account and all associated data from Settings → Account & Data Deletion. Deletion is processed within 30 days and cannot be undone.

We may suspend or terminate an account that breaks these terms, or that we reasonably believe is being used to harm the service or another player. Where the circumstances allow it, we will tell you why.

Disclaimers And Limits

CIPHER is provided "as is" and "as available", without warranties of any kind, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for any loss of data or progress. Because CIPHER is free, our total liability to you for any claim relating to it is limited to one hundred United States dollars (USD 100).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is so, the exclusions and limits above apply only to the extent permitted, and nothing in these terms limits liability for fraud, for death or personal injury caused by negligence, or for anything else that cannot lawfully be limited.

If You Downloaded CIPHER From the App Store

Apple requires us to set out the following, and it applies in addition to everything above whenever you use CIPHER on an Apple device.

This agreement is with us, not Apple

These terms are concluded between you and Blocks Foundry LLC only. Apple is not a party to them, and we, not Apple, are solely responsible for CIPHER and its content.

What your license covers

We grant you a non-transferable license to use CIPHER on any Apple-branded product that you own or control, as permitted by the Usage Rules in the App Store Terms of Service. Other accounts associated with you through Family Sharing may use it on the same basis.

Support is ours

We are solely responsible for providing any maintenance and support for CIPHER. Apple has no obligation whatsoever to furnish either.

Warranties are ours

We are solely responsible for any product warranties, express or implied, to the extent they are not effectively disclaimed above. If CIPHER fails to conform to an applicable warranty, you may notify Apple, and Apple will refund what you paid for it — which, as CIPHER is free, is nothing. To the maximum extent the law allows, Apple has no other warranty obligation of any kind, and any other claim, loss, liability, damage, cost or expense arising from a failure to conform to a warranty is ours alone.

Claims about the app are ours

We, not Apple, are responsible for addressing any claim you or a third party makes relating to CIPHER or your possession and use of it — including product liability claims, any claim that CIPHER fails to meet a legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.

Intellectual property claims are ours

If a third party claims that CIPHER, or your possession and use of it, infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement and discharge of that claim.

Where you are

You represent and warrant that you are not located in a country subject to a US Government embargo, or designated by the US Government as a "terrorist supporting" country, and that you are not listed on any US Government list of prohibited or restricted parties.

Other agreements you are under

You must comply with any applicable third-party terms when using CIPHER — your wireless carrier's data plan, for example.

Apple may enforce these terms

Apple and Apple's subsidiaries are third-party beneficiaries of these terms. On your acceptance of them, Apple has the right — and is deemed to have accepted the right — to enforce these terms against you as a third-party beneficiary.

Changes To These Terms

We may update these terms. The version and date shown at the bottom of them in the app tell you which version is current. Material changes will be brought to your attention in the app before they take effect, and continuing to use CIPHER after that means you accept the updated terms. If you do not accept them, stop using the app and delete your account.

Governing Law

These terms are governed by the laws of the State of Georgia, USA, without regard to its conflict-of-laws rules. Any dispute that cannot be resolved between us will be heard in the state or federal courts located in the State of Georgia, and you and we each consent to the jurisdiction of those courts.

If you live somewhere else, this does not take away the protection of any mandatory consumer law of the place where you live, or your right to bring a claim there.

Severability

If any part of these terms is found unenforceable, the rest continues to apply. Our not enforcing a provision on one occasion is not a waiver of it.
